ASSERTIVE APPROACH OF CIC











It refers to yet another admired verdict by Chief Information Commissioner in Appeal Number CIC/WB/A/2006/00984 ‘Kousnuma Nand Joshi vs Election Commission of India’ wherein apart from applying normal provisions of ‘Right To Information Act’, he directed to send copy of the submissions of the appellant to Lok Sabha Speaker for his consideration of suggestions of national and public importance. I recall same strategy was adopted by CIC in my appeals against Lok Sabha and Rajya Sabha Secretariats when he directed my submissions to be forwarded for personal attention of Union Minister for Law & Justice.











Such strategies adopted by CIC exhibit positive attitude and assertiveness of authorities in dealing with matters brought before them. Information Commissioner OP Kejriwal is also likewise known for being amongst most assertive and appellant-friendly Information Commissioners. But not all the Information Commissioners are so assertive and sensitive towards even genuine grievances of the appellants. Central Information Commission should also have a data of appeals/complaints admitted or dismissed by different Information Commissioners to reveal contrast strategies adopted by different Information commissioners in dealing with appeals/complaints presented before them.
